Agreement

Acceptance of these terms.

By accessing or using feasibility-study-company.com (the “site”), you agree to be bound by these Terms of Use and by our Privacy Policy. If you do not agree with them, please do not use the site.

These terms apply to every visitor and user of the site. They govern your use of the pages, content, and tools we publish, but they do not by themselves create any engagement between you and Feasibility Study Company. Any professional engagement is governed by a separate written agreement. We may revise these terms from time to time as described in Changes to these terms, and your continued use of the site means you accept the version then in effect.

Nature of Our Work

Independent analysis, not advice.

Feasibility studies and market studies prepared by Feasibility Study Company are independent, third-party analysis. They are not legal, tax, accounting, investment, or lending advice, and they are not a guarantee of any outcome, approval, or value.

The information on this site, and any study, report, or analysis we prepare, is provided for informational and decision-support purposes. It does not constitute legal, tax, accounting, appraisal, investment, or lending advice, and it is not a substitute for the advice of qualified professionals you engage for that purpose. You are responsible for your own decisions and for obtaining any independent advice those decisions require.

A feasibility study is an analysis of whether a specific project is likely to generate the demand and cash flow described under stated assumptions and conditions. It is not a promise, warranty, or guarantee that any projection will be achieved, that any loan will be approved or funded, that any agency, adjudicator, or investment committee will reach a particular conclusion, or that any property will attain a particular value. Forward-looking statements necessarily rest on assumptions and on information available at the time, and actual results will differ.

Any right to rely on a study we prepare is defined solely by the written engagement agreement for that study and extends only to the parties named as reliance parties in it. Absent a written engagement that names you, no study, report, or item of content on this site is directed to you, constitutes advice to you, or creates any duty or liability on our part. Nothing on the site should be read as an offer, solicitation, or recommendation to enter into any transaction.

Use of the Site

Permitted use of the website.

You may view, download, and print pages from the site for your own internal reference, provided you do not remove or obscure any copyright, trademark, or other proprietary notices. All other use requires our prior written permission.

When using the site, you agree that you will not:

  • use the site for any unlawful purpose or in violation of these terms;
  • copy, reproduce, republish, distribute, sell, or create derivative works from the content except as expressly permitted;
  • use automated means to scrape, harvest, or systematically collect content in a way that burdens or disrupts the site;

The “Feasibility Study Company” name and logo are marks of the practice and may not be used without permission.

Except for the limited permission described in Permitted use of the website, no license or right to any content, mark, or other intellectual property is granted to you, whether by implication or otherwise. Any deliverable prepared under an engagement remains subject to the intellectual property and use provisions of that engagement agreement.

Disclaimers

The site is provided “as is.”

The site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the content is accurate, complete, current, or fit for any particular use.

While we take reasonable care in preparing the material we publish, we do not warrant that the site will be uninterrupted, secure, or free of errors or harmful components, and we are not responsible for any decision made in reliance on general information published here. Warranties, if any, with respect to a specific study are set out exclusively in the engagement agreement for that study and not on this site.

Liability

Limitation of liability.

To the fullest extent permitted by law, Feasibility Study Company and its owners, personnel, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your access to or use of, or inability to use, the site or its content, whether the claim is based in contract, tort, statute, or any other theory, and even if we have been advised of the possibility of such damages.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law. Any liability arising from a professional engagement is governed exclusively by the terms of the applicable engagement agreement and not by these Terms of Use.

Indemnification

Indemnification.

You agree to indemnify, defend, and hold harmless Feasibility Study Company and its owners, personnel, and agents from and against any claims, liabilities, damages, losses, and expenses—including reasonable legal fees—arising out of or connected with your misuse of the site, your violation of these terms, or your infringement or violation of any right of a third party.

Governing Law

Governing law.

These terms, and any dispute arising out of or relating to them or to your use of the site, are governed by the laws of the United States and of the state in which the practice is based, without regard to conflict-of-laws principles. The governing law, jurisdiction, and venue for any matter arising under a specific engagement are set out in that engagement agreement and control over this section for that matter.

Any dispute relating to the site that is not subject to an engagement agreement will be brought exclusively in a court of competent jurisdiction within the United States, and you consent to the personal jurisdiction of those courts.

Changes

Changes to these terms.

We may update these terms at any time by posting a revised version on this page and updating the “last updated” date above. Material changes take effect when the revised terms are posted. Your continued use of the site after that time constitutes acceptance of the updated terms, so we encourage you to review this page periodically.
